No one can really argue that they are not aware of system resources using the specified storage.
The complaint further alleges that Apple, knows about it, but not able to provide any notification in advertising or marketing materials.

They're gonna refer back to Microsoft and Seagate suits and the this suit will be dropped. Just like a pc, formatted volume will be less than what the storage states on the box, plus, the space needed to store the OS, drivers, etc.

I just bought a Samsung Galaxy S5 with 16GB of onboard flash. Fully half of it is consumed by Samsung and Verizon crapware that I can't delete.

This is stupid. Not just Apple do it, every phone and PC maker advertise their products with the full capacity of their storage. Apple are the lords of the courts, and this one will be an easy win for them.
